Bail is the money a defendant must pay in order to be released from jail. A bond is posted on a defendant's behalf, usually by a bail bond company, to secure his or her release. Defendants with pending warrants are usually not eligible for bail.
The accused can pay the full bail amount on his or her own behalf to the court or pay a bail bond agent 10% of the amount (up to 15% for defendants from out-of-state). The bail bond agent will then pay the jail the full amount in the form of a bail bond/appearance bond. The arrested individual is then released from jail until his or her trial date.
The courts will set a defendant's bail and the bail bond company will post the bond at only 10%. A co-signer guarantees the full amount of bail will be paid if the defendant does not appear in court for trial.
A co-signer is the person responsible for guaranteeing the defendant attends all court dates and pays any fines.
In order to help the defendant, the bail bond agent must be given the following information:
In most cases, no. The fee that you pay is earned by the agent once the defendant is released from jail.
